Terms of Service

These Terms govern your use of SuperMon (the “Service”), at supermon.com.au, operated by Durga Prasad Sahoo (ABN 44 196 713 458) (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What SuperMon does

SuperMon is a monitoring and alerting tool that connects to your Xero account (read-only) to track Payday Super deadlines, flag overdue pay runs, and estimate potential exposure. It is an informational aid only. SuperMon is not financial, tax, accounting or legal advice, and it does not pay superannuation, lodge anything with the ATO, or guarantee compliance. You and your clients remain solely responsible for meeting super guarantee obligations, making payments on time, and independently verifying all dates and amounts.

2. Eligibility & accounts

  • You must be at least 18 and provide accurate account information.
  • Authentication is handled by our provider (Clerk). Keep your login credentials secure — you are responsible for activity under your account.
  • Notify us promptly of any unauthorised use.

3. Connecting Xero

When you connect Xero, you authorise SuperMon to access the relevant data on a read-only basis. You confirm you are permitted to connect and use that data. You can revoke access at any time from within Xero or by disconnecting the organisation in SuperMon.

4. Subscriptions, billing & cancellation

  • Paid plans are billed in advance via Stripe (monthly or annual) and renew automatically until cancelled.
  • You can cancel at any time. Your plan stays active until the end of the current paid period, after which it will not renew and you will not be charged again. You keep access until then.
  • Fees are non-refundable except where required by law — see our Refund Policy.
  • We may change pricing or plan features; changes apply to future billing periods and we will give reasonable notice.

5. Acceptable use

You agree not to misuse the Service, including: using it unlawfully or for unauthorised data; attempting to reverse engineer, scrape, or disrupt it; or reselling or sublicensing access without our written permission.

6. Availability

We aim for high availability but do not guarantee uninterrupted or error-free operation, and may change, suspend, or discontinue features from time to time.

7. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant that calculations, deadlines, statuses, or data are accurate, complete, or current — results depend on data from Xero and other third parties, and on the timing of synchronisation. You must independently verify any information before relying or acting on it.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for ATO penalties, interest charges, missed deadlines, or loss arising from reliance on the Service. Our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid to us in the 12 months before the event giving rise to the claim.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (or other law) that cannot lawfully be excluded. Where we are liable for a breach of a non-excludable guarantee, and to the extent the law permits, our liability is limited to resupplying the Service or paying the cost of having it resupplied.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have non-exclusive jurisdiction.
